What to include
- 1. The exact URL(s) of the content you want removed (e.g.
chalais.app/{handle}/r/{outputId}). - 2. A description of the copyrighted work you own and how the content infringes it.
- 3. Your name, address, phone, and email.
- 4.A statement of good-faith belief that the use isn't authorized.
- 5.A statement under penalty of perjury that the information is accurate and you're authorized to act on behalf of the copyright owner.
- 6. Your physical or electronic signature.
The formal legal requirements are restated below in case you are filing on behalf of counsel or an organization.
Fairday Technology, LLC (“Fairday”) respects the intellectual-property rights of others and expects users of Chalais (the “Service”) to do the same. This policy explains how to report content on the Service that you believe infringes your copyright, how we respond, and your rights to file a counter-notice.
This policy implements the Digital Millennium Copyright Act, 17 U.S.C. §512 (the “DMCA”).
1. Notice of claimed infringement
If you are a copyright owner (or authorized to act on behalf of one) and believe that material accessible on the Service infringes your copyright, send a written notice (a “Notice”) to our Designated Agent (Section 4 below) that includes:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works at the Service are covered by a single Notice, a representative list of those works);
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to allow us to locate it (a URL is ideal);
- Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and an email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the Notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Misrepresentations.Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer or by Fairday.
2. Our response
Upon receipt of a valid Notice, we will (a) remove or disable access to the material identified, (b) take reasonable steps to notify the user responsible for posting it, and (c) keep a record of the Notice. If we cannot confirm that the Notice is valid we may request additional information. We acknowledge receipt of every Notice within one business day and act on valid Notices expeditiously.
3. Counter-notice
If you are a Chalais user and believe that material you posted was removed or disabled by mistake or misidentification, you may file a written counter-notice with our Designated Agent that includes:
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and the location at which it appeared before it was removed or disabled;
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the Central District of California), and that you will accept service of process from the person who provided the original Notice or that person's agent.
After we receive a valid counter-notice we may forward it to the original complainant. Unless the complainant files a court action seeking a restraining order against you within 10 business days, we may restore the removed material between 10 and 14 business days after receipt of the counter-notice, in our discretion.

5. Repeat infringers
In appropriate circumstances we will terminate the Accounts of users who are determined to be repeat infringers. We track validated Notices against each account and enforce this policy consistently.
